  1. The fitness center is an unattended facility. Persons using the facility do so at their own risk. Staff is not present to provide personal training, exercise consultation, or other assistance, including without limitation emergency assistance. Persons interested in using the fitness center are encouraged to consult with a physician prior to using the fitness center.

  2. Persons who are inexperienced with using any fitness equipment must be accompanied by another permitted user who is capable of assisting such person with the use of such equipment and is available to contact emergency services or otherwise render aid if necessary. Fitness equipment is recommended for the use of individuals within the appropriate age ranges, experience levels, and other characteristics as may be specified by the equipment manufacturer. Information and recommendations from the equipment manufacturer are attached hereto as Exhibit A.

  3. Food (including chewing gum) is not permitted within the fitness center. Water is permitted in the fitness center if contained in non-breakable containers with screw top or sealed lids. Alcoholic beverages are not permitted.

  4. Appropriate clothing and athletic footwear (covering the entire foot) must always be worn in the fitness center. Appropriate clothing excludes jeans and swim attire.

  5. Each person shall sanitize the fitness equipment before and after each use.

  6. Hand chalk prohibited in the fitness center.

  7. Except for Association management or other personnel operating the facility, no person shall cause or permit any device to play or transmit any music or other audio signal within the fitness center except for personal devices used exclusively in conjunction with headphones such that the music or other audio is exclusively transmitted through the headphones. Any Association audio or video equipment may only be used, manipulated, and operated by, or at the direction of, Association management or personnel operating the facility.

  8. No Association property, including without limitation weights or other fitness equipment, shall be removed from the fitness center.

  9. Please limit use of cardiovascular equipment to thirty (30) minutes and step aside between multiple sets on exercise equipment if other persons are waiting to use the equipment.

  10. No person shall drop any free weights on the floor and all such weights must be gently placed in their appropriate storage locations after use.

  11. Any fitness program conducted by the Association (if any) will have priority with respect to use of the facility and corresponding equipment over other users of the fitness center.

  12. Any person who believes any of the equipment may be malfunctioning or may create an unsafe condition shall immediately cease use of any such equipment and promptly report the issue to Association management or other personnel operating the facility.

  13. Organized coaching, private or personal training, and any commercial activity of any nature in connection with the fitness center are STRICTLY PROHIBITED. All instructors, coaches, or personal trainers that may be permitted must be independent contractors that must be approved, insured, and have a contract with the Association.

  14. Videography and photography are not permitted at any time in the fitness center.
